Notice of Intent to Pass a By-law to be known as The Netmizaagamig Nishnaabeg Removal of Trespassers and Drug Traffickers By-law enacted for the Removal and Punishment of Persons Trespassing or Frequenting the Reserve for Prohibited Purposes The Chief and Council of the Netmizaagamig Nishnaabeg is pleased to announce that it is has initiated a by-law for the Removal and Punishment of Persons Trespassing or Frequenting the Reserve for Prohibited Purposes including drug traff...icking. This by-law will be passed under the authority of the Council as set out in Section 81 of the Indian Act and our First Nation’s Chi-Naaknigewin, and has been initiated in response to ongoing issues with dangerous persons present within the community carrying out illegal activities that threaten the health, safety and well being of our citizens. The Council has retained legal counsel to assist with the drafting of the by-law and is working closely with representatives of the Anishinabek Police Service to ensure that the final by-law is fully enforceable by police. This work builds on the work of the Drug Awareness Committee and is intended to support the enforcement of prior decisions made by the Council including the eviction of certain persons from the Pic Mobert Reserve. As per the Chi-Naaknigewin, the membership will be given an opportunity to review and comment on the draft by-law, a copy of which is included with this notice. There will be three readings of the by-law. The first reading was held at the duly convened meeting of the Council held on November 18, 2020. The second reading will be held at the next scheduled meeting of the Council on December 2, 2020. The third and final reading will be held at a public meeting to be held during the week of December 14, 2020 (date and details to be confirmed), after which the by-law will be deemed approved and will be forwarded to the federal Minister of Indian Affairs and the federal Minister of Justice. The Chief and Council have also approved the entering into an agreement with the Public Prosecution Service of Canada who will be requested to prosecute charges laid under our by-laws in federal court. The Council remains dedicated to protecting the health, safety and well-being of our citizens, and will continue to aggressively pursue all possible options to hold those who threaten these fully accountable for their actions.
