BEING SUED FOR SPREADING COVID-19? IT CAN HAPPEN! Can I Get Sued for Infecting Someone with COVID-19? The short answer is Yes it is possible. Based on the law of negligence, it is possible to get sued for infecting another person with COVID-19. It is also possible to sue someone for infecting you with COVID-19.... In most jurisdictions in Ontario, the government has set out restrictions in respect of the pandemic and the spread of COVID-19. These restrictions include wearing masks, hand hygiene, social distancing, and limits on gatherings. Other restrictions include social isolation and quarantines for persons infected or persons suspected of being infected. Increasingly, people are experiencing COVID-19 fatigue and compliance with the rules and restrictions are not always being adhered to. If you choose not to comply with the restrictions and infect someone, can you be sued? The answer lies in the law of intentional tort and negligence. The word tort means in plain language a wrongful act. Certainly, if you know you are infected and knowingly - intentionally infect someone else, you would be committing an intentional tort and could be held liable to pay damages to the person you infected and perhaps their affected family members. In terms of liability in negligence, in Ontario, a person can be held liable for conduct that is negligent where that negligent conduct has caused someone else to suffer injury, loss or other damages. In plain language, if you act in a way that is unreasonable and you non-intentionally infect someone with COVID-19, especially if you know you have COVID-19, you could be sued and held liable to pay damages if it was reasonable foreseeable that your behaviour could infect another person. In theory, if a person knows they have COVID-19 or exhibits signs of having COVID-19 and fails to take reasonable precautions to avoid infecting another person, that person could be held liable in negligence. What types of damages could you be sued for? The damages could be significant. If a court finds you liable for spreading COVID-19, you could be ordered to pay damages for pain and suffering, medical expenses, loss of income, out of pocket expenses and perhaps punitive and aggravated damages depending on the facts of the case. If you are pursued for spreading COVID-19, you may have insurance that covers the claim. Your lawyer would need to review your policy of insurance to make that determination. Most policies of insurance do not cover intentional acts, however. Contact us if you receive a demand letter or a claim alleging negligence or the intentional spread of COVID-19. HOW TO ACCESS COURTS DURING THE COVID PANDEMIC. As a result of the Covid pandemic, the Courts in Ontario have had to adapt quickly. Here are some of the steps the Courts have taken to allow access to the Courts and provide access to justice: 1. The Province suspended time-periods under the Rules of the Courts and Tribunals for a set time period.... 2. The Province suspended limitation periods in Ontario for a certain time period. 3. The Courts have allowed parties and their lawyers to file documents electronically through email, online portals and the development of new online access points such as Caselines software. 4. The Courts have modernized their court rooms and offices to allow for video-conferencing for remote court appearances. 5. Judges and Court staff have been trained in the use of electronic means of communicating, document sharing, document filing and conduct of remote hearings. The ways in which lawyers now interact with the Court on behalf of their clients has changed significantly since March 2020 when the pandemic started.
