Going forward, Buyers need to practice extreme caution when placing offers. My recommendation is to have your Realtor thoroughly analyze (very) recent comparable sold before deriving an offer price. As part of pro active du...e diligence, I highly recommend presenting the said Listing to your Mortgage officer/Lender to ensure they're confident on your offer price from an appraisal perspective. Lets use this simple example for further clarity: Your offer gets accepted on a detached house at a price of 1.3M as of May 14th, 2022 with a closing date of June 30th, 2022. If due to factors like Buyer fatigue, rising interest rates, trends on the international front & excessive inventory, the average price of a detached in the said area reduces to 1.25M, Your mortgage lender "might" request you to increase your down payment by upto $50,000.00 due to this price drop. There's no doubt , timing the market is almost impossible, however being aware of this potential challenge & engaging/connecting with the mortgage lender prior to offer submission will serve as an enabler for an informed, relatively safer decision. For reference , here's a definition of "Bank Appraisal": "An appraisal determines the home's value to ensure that the price reflects the home's condition, age, location, and features such as the number of bathrooms. Lets dissect the Assignment Clause provision Authored by : Ali Khan, Sales Representative, Diamond Award Winner, IPRO Realty, 416 562 6811 In a nutshell , an assignment clause enables you to transfer your obligations to close the deal on a property to a new buyer & ... is typically executed to lock in profits without going through the steps of closing on a mortgage , paying land transfer tax etc. Specially in the world of pre construction projects , condos & low rise developments inclusive, the assignment clause is used as a major marketing strategy, an incentive if you will , enticing and attracting investors to secure units , pay significant deposits all while having the liberty to assign the unit to a new buyer , at a higher price & life is good. There's no doubt there's significant evidence of investors pocketing profits via assignment sales, but just like most investment vehicles, real estate assignment isn't always flowery. Here are some major challenges to understand & consider before confidently basing your investment strategy around a mere assignment clause : 1. Marketing Restrictions : Most pre con projects will prohibit you or your realtor to list your assignment on MLS which is undoubtedly the largest source of exposure for real estate sales; violating this restriction can result in consequences of varying degrees. You are in essence dependent on your or your realtor's network in hopes of finding a Buyer for your assignment. This restriction alone makes assignment sales very difficult. 2. Builder Permission : There's a strong chance you are unable to assign your unit without the Builder's approval. Yes, for the most part , the Builder has to give you permission to allow you to try and assign your unit, again , more than likely prohibiting you from posting your assignment on MLS 3. Assignment Fees: Yes, there's typically a fee involved in assigning your unit, i.e. IF the Builder authorizes an assignment sale, they can charge you anywhere from under a thousand dollars to 120000 or more. 4. Responsibility & complexity of closing : Consult an assignment expert, a lawyer & an accountant to understand all that's involved in terms of closing an assignment. For now , what we need to understand is the following: If the person who you assigned / "sold" the unit to fails to close, You are still on the hook. 5. New Tax implications: Disclaimer : for all tax related matters consult a certified accountant, for now we need to understand this : the proposed federal budget for 2022 mandates a major tax change when it comes to assignment sales which will significantly impact profits & one must understand these new tax implications before investing in real estate even remotely banking on the Assignment provision.
