On December 4, 1849 Shingwaukonse surrendered to authorities for his part in the Mica Bay incident. Anishinabe historian Dr. Alan Corbiere suggests in this article that there may be no #RHT1850 or Annuity/escalator if not for his protests. "It is important to note that Shingwaukonse knew that his band owned the land and everything upon and in it, the timber, the hay, the fish, the animals, and the minerals. It is also important to note that he wanted a monetary share from an...ything removed from his territory. After at least 13 years of councils, petitions, diplomatic missions, and an armed stand-off, Shingwaukonse was able to bring the government to the negotiating table and was able to secure a treaty with an annuity for perpetuity, an annuity that was supposed to increase once the province received profits enough to not incur a loss. Today, many people in the Robinson-Huron Treaty area receive their four dollars and many make remarks about how pitiful the amount is, but many may not realize that if it were not for the sustained efforts of Shingwaukonse, they would not be lining up at all, and perhaps no further treaties would have been signed after 1836." "Beaulieu, a Government of Canada witness, was testifying on Day 33 of the trial of a lawsuit filed by Robinson-Huron Treaty First Nations concerning annual annuities to be paid by the federal government. The lawsuit, which was launched in 2014, got underway Sept. 25 in Thunder Bay. The case then shifted to Garden River First Nation and Manitoulin Island. The Greater Sudbury portion (and final ...stop) began two weeks ago. The thrust of the lawsuit concerns the 1850 Robinson-Huron Treaty, specifically annuity augmentation. The 21 Robinson-Huron chiefs are arguing that the annual $4 annuity paid by the Crown per treaty member has not changed since 1874, 24 years after the treaty was signed, despite a commitment that the annuity was to increase as revenues generated on their territories increased." https://www.thesudburystar.com//46764f34-f776-a205-740c-e3

This is a relatively new article on the Mica Bay Incident by Garden River First Nation historian and Mount Allison University Professor, Dr. Karl S. Hele. The article discusses the Mica Bay Incident, what circumstances led to the Incident and the impact the Incident had on the signing of the 1850 Robinson Treaties. "In November 1849, a force of Anishinaabeg (see Ojibwe) and Métis warriors, led by Chiefs Oshawano, Shingwaukonse and Nebenaigoching, forced the Quebec and Lake ...Superior Mining Association to stop operating at Pointe aux Mines, Mica Bay, Lake Superior. Mica Bay is approximately 100 km northwest of Sault Ste. Marie (by road) on Lake Superior. The closure of the mine and the reaction of the Canada West authorities are known as the Mica Bay Incident... The actions of the chiefs forced the Canada West government to negotiate in 1850. The Robinson-Huron and Robinson-Superior Treaties legitimated the mining leases, created reserves, recognized First Nations rights, and set precedents for future treaties (see Robinson Treaties of 1850). Each treaty also contained annuities (annual payments) for the bands along with an escalator clause. The escalator clause was designed to raise the annuities as profits from the extractions of resources increased. The failure of the Crown (see Federal Government) to follow the escalator clause has led to a claim that is currently before the courts.
