As we all may have heard, section 33.1 of the Criminal Code of Canada had been overturned in a court case in Ontario this past June. Section 33.1 outlines when the defence of self-induced intoxication is not an available defence. Recently, here in Calgary, our Courts ruled that section 33.1 offends sections 7 and 11 of the Charter and was not saved by section 1.
