We are pleased with the recent decision of the Ontario Court of Appeal released on October 16, 2019. We had represented the Wife, where the Husband had filed for a divorce in a foreign jurisdiction without providing the Wife with the proper notice of the divorce proceeding. The main reason for such action by the Husband was to gain a financial advantage to not pay spousal support to the Wife under the Canadian jurisdiction. We had successfully represented the Wife in both cases at the Superior Court of Justice and Ontario Court of Appeal, where justice was served.
