Finished a file today. Client received a $65k settlement payment in Small Claims action. This file took little more than 2 months from the start to completion, but results are obviously perfect. The amount of the settlement is twice bigger that the court may award.

Ontario government has changed today an Employment Standards Act and extended a time limit after which temporary lay-off becomes deemed termination. SCC finally released its judgement in Heller v Uber technologies Inc and rulled that arbitration clause to refer all claims to Netherland arbitration was void as it was unconscious. The effect of such clause was to preclude drivers from the opportunity to effectively protect their rights, and as such was contrary to the principles of the fundamental justice. This judgement also has opened the gates for the future series of huge class actions in employment law. Have you been terminated? Laid off? Let me check what is your entitlements are. Its free and no obligations. Here is one example. An employee worked little mo...re than 3 years in a company for $21 per hour. He has been terminated and received 3 weeks of pay upon termination as per Employment Standards Act requirements. The Court made an order and awarded extra 9 weeks on a top plus legal costs as an entitlements under a common law. As a result employee was awarded $9200. In some cases employee may get much more than that. And don’t think that if you have no contract you have no rights. Don’t think that if your contract says that you entitled only to 2 weeks notice that there is a truth. Termination clause may be void and have no force or effect. Here is a good example. Recent week ruling in case of Waksdasle v Swegon North America 2020 ONCA 391 is really earthbreaking one. Ontario Court of Appeal find that: 1) a termination clause saying that employee woud have no termination pay in case if he will be terminated for cause is void as it is in violation of Employment Standards Act; 2) employee is entitled to termination pay under a common law (which is about 4-5 times more than those under employment standards). What is wrongful dismissal? A wrongful dismissal occurs when an employee is dismissed, or terminated, by their employer, but not given reasonable notice. Notice upon termination may be provided as working notice (meaning that you continue to work up until the date of your termination), or payment for the same period of notice (which means you don't have to work but you still be paid).... Employment Standards Act established minimal notice requirements which mean lower standard. Most of the employees in Ontario are still entitled to common law notice which is more beneficial to the employee. The difference sometimes may be thousands of dollars. Even if the Contract state that you are entitled to the notice according to the Employment Standards Act or similar language, please let us review your entitlements as such condition may be void or unenforceable and you deserve much more than you think you are.
