A newly-created Task Force, composed of four former Canadian and American politicians, will try to determine the right moment and process to reopen the Canada-U.S. border. The panel, staffed by the Canada Institute and its director, Christopher Sands, will deliver recommendations in March 2021. The Task Force is expected, over the next few months, to "meet virtually with various public-private sector stakeholders to understand the challenges of health screening and border security, as well as the impact of the border restrictions on communities, public health, and economic recovery," in order to make their recommendations, ccording to a press release issued by the Wilson Center. https://www.google.ca//task-force-to-look-at-how-to-r/amp/

FAQ - What is going on with the Safe Third Party Agreement? Canada has appealed the recent federal court decision on the safe-third party agreememt. The stated purpose of theSTCAis to allow the U.S. and Canada to coordinate Canadian and U.S. immigration, including emphasizing the need to stop ‘forum shoppers’individuals who may attempt to apply for refugee status in both Canada and the U.S.... Asylum seekers are typically required to claim asylum in the first ‘safe’ country that they enter. The U.S. is considered a ‘safe’ country for the purposes of theImmigration and Refugee Protection Act(IRPA). On 22 July 2020, the Federal Court of Canada released its decisioninvalidating the provisions which enacted theSTCAon the basis that they violate section 7 of theCanadian Charter of Rights and Freedoms.The impact of this decision is that the Canadian government cannot return asylum seekers to the U.S. without infringing on the constitutional rights of life, liberty and security of the person. However, the Court suspended the declaration of invalidity for 6 months, to allow the Canadian government to respond. In rendering this decision, the Federal Court pointed to evidence of the extensive use of detention of asylum seekers in the United States, and the increased likelihood of deportation to countries where there was a high risk of persecution for these asylum seekers. On August 21, 2020, Bill Blair, Minister of Public Safety and Emergency Preparedness, released an official statement that the government of Canada would be appealingCanadian Council for Refugees. As the matter is still before the courts, it will be very interesting to see how, if at all, the upcoming US elections will impact this case. . . . .
