Buyers of pre-construction condos and condo townhomes often ask us why they cannot list their units for lease or sale prior to final closing, during the occupancy period. The main reason is because the builder doesn’t want any competition if there are any unsold units; furthermore, while you may have possession of the unit and a license to occupy it, you are not the legal owner of the property until final closing and title is transferred into your name. In this recent case, ...the buyer’s deposit was ordered forfeited by the court, in accordance with the contract, because he listed and sold a property without the builder’s consent during the occupancy period.
