This lawyer is disconnected from the realities of the judicial system of 2017 and completely disregards Junior lawyers and Paralegals with their involvement in ...the Small Claims Court. Firstly, Ontario does not widely support individuals to be completely self-represented in the Small Claims Court. Court Clerk Staff are first to advise a person with questions to retain a lawyer or paralegal. Secondly, for the efficient and expedience of Justice, the Small Claims Court should absolutely be raised to $50,000.00. I have many clients who initially call me with claims of $30,000.00 to 45,000.00 and I advise them that they are limited to being awarded $25,000.00 + court cost and interest with my services. Disappointed, I advise them to see a lawyer first and discuss proceeding to higher court. Many of these people call me back and "waive the excess" because a lawyer and court fees are going to cost more than the $35,000.00 claim. Thirdly, with inflation and the cost of depreciation, $25,000.00 is worth a lot less in 2017 than it was in 2008 when Small Claims went from $10,000 to $25,000.00. Raising Small Claims aids in maintaining the monetary jurisdiction against the cost of depreciation and also aids in access to justice! Finally, Alberta doubled their Small Claims Court to $50,000.00 and I would apperciate this lawyer substantiating her allegations of Ontario being a completely different justice system that warrants such special considerations as to not replicate Alberta's actions in doubling the Small Claim amounts. I see Ontario as a progressive province with more affordable access to justice with licensed Paralegals and Junior Lawyers where a claim of $50,000.00 should be heard in Small Claims Court not to burden the over crowded and expensive higher courts. If Ontario and Alberta have been following suit with each other on many decisions including Courts, Minimum wage and legal representation, why should it suddenly halt? This lawyer needs a reality check of 2017 and update herself on the access to justice in a progressive legal system. There needs to be a cease on lawyers being self-serving with the judicial system and realize that the public demands affordable access to justice in which affordable access cannot fit into the business model of a lawyer. If this lawyer is gravely concerned about her livelihood being encroached by a small increase of $25,000.00 to the Small Claims Court, perhaps this lawyer should revamp her business model to serve 2017.
