The Role of the Personal Real Estate Service Corporation Many in the business have taken advantage of setting up a new personal real estate service corporation. Since then, many questions have come up regarding what exactly can be done under the umbrella of this new corporation. To answer this question, first, I would say try not to think of this new personal services corporation in the same way you might think of a normal company. It is not. This personal services corporat...ion is very limited in what it can do. Effectively it can only do the things that a functioning realtor or agent can do. The Real estate services act of Manitoba gives the definition of real estate services and as you may know it is quite limited. These services are trading services, property management services, and private sales services. The regulations expand it a bit into negotiation type services, but that same regulation also states that these new personal real estate corporations can only provide these same real estate services. This means no owning of land or investments by the corporation or anything else that might be income producing ultimately. Pure real estate services, that it. ZONING CHANGES In Real estate, you will see land being developed for the first time, or being re-developed as something new, better, or different than it was before. Often this requires that the land be re-zoned by the municipality. Every piece of land has a zoning designation. This allows the municipality to control what is built on any given piece of land. For example, if the land does not have an R zoning, you cannot build a house on that land without special permiss...ion. If the land does not have a C zoning designation you cannot build a Walmart on the land without special permission. When land is changed in terms of its zoning designation, a whole new set of possibilities opens with that land, and once re-zoned, the owner can apply to do all sorts of new things. If that ability is granted, the municipality might state that to evolve the land they want the new owner to comply with a group of conditions, which are contained in a zoning agreement which then may be registered against title of the land. If you come across this on title, often on newly developed or vacant land, make sure the client understands the conditions that they must be comply with before they can develop or build on the land. This is generally not an issue in large areas of new housing developments, you will see many registrations on title, but they are benign and exist mostly to ensure all the houses in the new area adhere to the master plan of development. If, however it is a small development or there is a unique development that departs from the area norm, have a closer look. SEWAGE EJECTOR SYSTEMS If you are selling or buying rural properties, you may come into contact with properties that have sewage ejector systems. Sewage ejector systems are a type of sewage system where the sewage is pumped from the house, into a tank, and then from the tank, up to the surface, where sewage effluent is sprayed onto a portion of the lot where it evaporates or is assumed into the soil. These systems used to be more common but now, not surprisingly, they are bec...oming extinct. It is illegal to build a new sewage ejector system in Manitoba. It is only a question of managing old ones. The authorities want to phase them out and they look at transfers, sales and subdivision of the property as a chance to do just that. If you transfer or subdivide a property you must get rid of the ejector system. There are a few exceptions to this such as situations where the property is at least 10 acres, the discharge area is entirely on the property, not too close to the boundary and not in a sensitive area. There is a system that exists that apparently does allow people to ask for a variance. If you have a property like this, owners can apply for an assistance program to replace the system and they can pass this on to the purchaser, if everyone agrees.
