New Legislation Changes to come to Ontario for Distracted Drivers With the increasing amount of accident due to distracted drivers, Ontario plans to introduce new legislation for drivers who cause an accident and cause harm or death to another. The Highway Traffic Act at the moment provides that an individual who causes an accident, regardless of them being distracted or not, will get charged with Careless Driving. At the moment, being convicted of Careless Driving means that... the accused will have lost 6 demerit points, be issued a fine and in some circumstances could face an incarceration period of up to 6 months. With the new legislative changes that the government is planning on introducing soon, this would change! Individuals whom are found guilty of Careless Driving and have caused harm to another, or death, will now be facing the possibility of an escalated fine up to $50,000 dollars, possible license suspension of up to 5 years, and in some cases, a period of incarceration of up to 2 years. Further, the government plans on introducing stricter laws for individuals charged with using a cell phone, and escalated sanctions for novice drivers that have a B.A.C above zero. Some individuals who receive a ticket under the Highway Traffic Act choose to go to court by themselves and be self represented. There is nothing wrong with wanting to represent yourself, although it is not recommended. With the new legislation that the government is planning on introducing, it is even more imperative now that anybody charge with an offence hire a legal representative as soon as possible.
