We will be increasing our reliance on virtual meetings and teleconferences as much as possible, to minimize the need for face-to-face meetings during the period where our government has wisely recommended we limit contact. Like many organizations, we are closely monitoring personal travel and self-quarantine guidelines. Should circumstances require a temporary closure of our office premises, our professionals will endeavour to be as accessible as possible to continue to deliver service to our clients. At this time, we are implementing the following procedures to minimize the spread of COVID-19: All initial appointments for estate planning, estate administration, and incorporations will be done by teleconference or videoconference. Unless urgent because of illness or other medical emergency, or a financial emergency that cannot be delayed, all signing appointments for wills, probates, and incorporations will be postponed until at least the middle of April. If you are able to extend your real estate matter, for example on a refinance, we ask that you attempt to do so. If you have travelled outside of Canada, have been in close contact with someone who has been outside of Canada, or believe you may have been exposed to COVID-19, and still require an in-person meeting, we ask that you notify us immediately. We have staff who are at elevated risk if they contract this virus and we will need to take elevated protective measures for their safety. Today is National Advance Care Planning Day. Many people underestimate the importance of powers of attorney, but they are a critical piece of planning for your future care - especially now. We are very pleased to hear that, temporarily during this crisis, Ontario will be allowing wills to be witnessed virtually.
With all of the news flying around about the shutdown tomorrow, we want to let everyone know that we are, effectively, fully virtual at this point and so can complete active real estate closings. Between zoom and wire services, we can get it done if you have a contract that you can't extend. Instructions are the easy part; signing is not. We have been in touch with the Attorney General's office to see if they can implement temporary rules to allow us to witness wills remotely. It's the end of November, and the end of Make a Will month. Did you know that marriage automatically revokes a will in Ontario? If you have children, and you are legally married to someone other than their other parent, getting married may have accidentally disinherited your children. If you are in a blended family, you owe it to your loved ones to sit down with a lawyer who does estates work.
We often see clients who have children living outside of Canada. This can create additional complications, particularly if you want one of these children to be your executor. If you are in this situation, it is very important to have your will professionally drafted.
Most people forget about digital assets when it comes to their estate plan. If most of your family photos and music are digital, you may have to take extra steps - including specific wording in your will - to be sure that your family can access them, let alone own them, after you die. Be sure that your treasured family memories are protected by having a properly and professionally drafted will.
We take a moment today to remember all those who have served to make this country a just and democratic one.
Do you have a child who is neuroatypical, or has a disability? If so, you DEFINITELY need a will, and you need one drafted by a lawyer, so that they will not have their government funding affected by an inheritance.
