The initial consult: A tool for preventing legal disputes Many people and businesses who are faced with legal issues delay consulting a lawyer or forego hiring ...a lawyer altogether because of the high costs. In many cases that we handle, clients that retain us have already prepared contracts, formal letters or demands before the courts on their own and begin seeking help from a lawyer only when their legal problems seem insurmountable. While this approach may be attractive in the short-term, it often ends up being more costly in long run. Even if you do not intend to hire a lawyer to draft legal documents or handle your entire case, an initial consult can be a powerful tool to get legal information, strategy tips and insight from someone with legal expertise. A legal consult can also be helpful to obtain references to additional publicly available sources of legal information. When we consult with people who have started the legal process on their own, we run into many of the same problems again and again, a few of which we have outlined below. Firstly, many clients fail to keep adequate records and proof. In court, written documentation is essential to prove the existence of agreements and any modifications to agreements. If the agreements are not written, or at least confirmed in writing, testimony may be inadmissible or given little weight by the court. Consulting with a lawyer early on in the dispute allows you to know what kinds of documents and proof will be necessary should the matter end up in court. Secondly, clients may inadvertently make admissions in exchanging correspondence with another party. We have often handled cases where a client sabotaged himself by writing an off-the-cuff email that could be construed against him. Consulting a lawyer also help you figure out what and when not to write. Thirdly, even when written documentation exists clients who do not properly draft, organize and preserve their documentation put themselves at a disadvantage when it comes to preventing and resolving legal disputes. Agreements, invoices, receipts, requests and complaints can all be essential to a case and when they are not well drafted or well organized can cause delays and expense in solving legal problems. Creating quality models of common documents and developing a system of document organization is not only more efficient, but will also help protect your legal rights. This is especially important for small businesses and sole-proprietorships who often have the most to gain from proper documentation. In conclusion, it is often more efficient to seek legal advice preventatively rather than curatively. Get to know your legal rights and potential pitfalls in the early stages of a dispute rather than after proceedings have been instituted. If you are running a small business, getting help creating quality models of contracts, invoices and other documents can help prevent costly disputes in the future.
