BIM LAW 06.10.2020

Here's wishing all our clients a Happy New Year. Please be informed about changes to Child support payments, as it concerns section 7 expenses. We find that most Court Orders granted prior to September 2016, are lacking in details on what section 7 expenses should be covered by the parties. Section 7 Child Support expenses would typically include daycare costs, extracurricular activities for the children, insurance premiums for medical and dental coverage, out of pocket expen...ses for medical and dental expenses, therapy etc. It is important to ensure that your Child support Order is very specific and clear on what section 7 expenses are to be covered, and what percentage each party is expected to pay from the total amount incurred on behalf of the child(ren). The Maintenance Enforcement Agency (MEP), the body that enforces support payment are stricter with the guidelines and it's enforcement. Accordingly, make sure you get it right the first time, so you don't have to keep returning to Court to vary or amend your Support Order. If you require further information please visit the MEP government page at https://www.justice.alberta.ca//Pages/Section7expenses.aspx If you require legal assistance in regard to the above or in regard to other Child support matters, please contact our office to set up a consultation.

At BIM LAW, we encourage parents to always consider their children's best interests in custody matters. It is imperative for parents to understand that while a separation may be a difficult period for the parties involved, it is more difficult for the child. We find that children are often dragged into this conflict and some of the consequences of this decision or action is not noticed until later. Science has shown that children go through depression and anxiety, especially... when they feel helpless and torn. We encourage our clients, man or woman, dad or mum, to consider the fact that each parent has something unique to contribute towards a child's upbringing and overall wellbeing. We find that children who know that they are loved by both parents and that their parents respect each other even post separation, thrive very well and are more confident. Disclaimer: We do not encourage exposing children to domestic violence or abuse in the name of keeping the family together. The child's safety and wellbeing should always be the priority.
