Guerin v. Guerin- Exclusive Possession and Electronic Access Amid COVID 19 The Courts are starting to make important decisions about the effect that COVID 19 protocols are having on parenting agreements. In the case of Guerin v. Guerin the Court considered pre-existing health conditions of the Mother and the failure of following the COVID 19 protocol on the part of the Father. The Court granted the Mothers request, namely that the Father have only electronic access to the children and remain out of the matrimonial home. The Court was clear that decisions changing existing parenting agreements will be dealt with on the facts of the specific case and will likely be temporary.
