Fantastic news - Congratulations to all who have fought for years for this day! A momentous unanimous ruling that will have implications for the rest of the wor...ld where there are laws that were modeled on the Section 377 law. Over the years I've had the opportunity to work with many of the activists in India and internationally - Phyllis and I celebrating. We will also launch the Envisioning anthology next week (the last outcome from the Envisioning project). The first chapter, by Arvind Narrain, is on the history of the India case. Speaking personally - this is an amazing moment to culminate the Envisioning project. Fantastic News today. In a landmark judgment today, the Supreme Court of India unanimously ruled to decriminalize same sex sex, striking down a 157 year old law. India’s chief justice, Dipak Misra said the law was irrational, indefensible and manifestly arbitrary and Respect for individual choice is the essence of liberty. The court affirmed that gay people are entitled to constitutional protections under Indian law and that discrimination based on sexuality is illegal. T...he ruling transforms gay rights in a country of more than 1.3 billion people and will have huge repercussions in other countries, particularly throughout the Commonwealth, where there are similar legal battles against colonial era laws. A new anthology will be launched on Sept. 13 which examines the history of the struggle against the law in India as well as other precedent setting developments in Africa and the Caribbean.
