At the annual meeting of the Western Canada Commercial Arbitration Society (WCCAS) on November 13, 2020, Farris Partner, Ludmila B. Herbst, Q.C., presented a case law update related to domestic (i.e., non-international) commercial arbitration. Cases over the past year have dealt with wide-ranging topics including the appointment of arbitrators, staying court proceedings in favour of arbitration, striking court proceedings commenced in face of an arbitration agreement, and t...he process, standard of review and remedies associated with challenges to arbitration awards. Farris Partner, Ludmila Herbst, Q.C., presented on the topic of arbitration appeals as part of a national panel on Arbitration Appeals in Commercial Cases: The Good, the Bad and the Ugly. The webinar, which was held on October 16, 2020, was organized by the ADR Institute of Canada and included remarks by former Supreme Court of Canada justice Clément Gascon as well as a well known Toronto arbitrator, counsel from law firms in B.C. (Ludmila) and Alberta, and counsel for the... federal Department of Justice. Ludmila spoke on the appeal provisions of B.C.’s new Arbitration Act, which came into effect on September 1, 2020. Ludmila often acts as counsel in arbitration cases and is one of the two co-authors of Commercial Arbitration in Canada: A Guide to Domestic and International Arbitrations. Farris Partner, Ludmila Herbst, Q.C., is one of the co-authors of Commercial Arbitration in Canada: A Guide to Domestic and International Arbitrations. The publisher, Thomson Reuters, is re-issuing the book which was first published in 2004 and is updated each year or so this month both electronically and in print. The text has been cited numerous times by trial and appellate courts across Canada, including in recent judgments of the Supreme Court of Canada in Uber Technologies Inc. v. Heller, 2020 SCC 1 and TELUS Communications Inc. v. Wellman, 2019 SCC 19. Ludmila and other Farris litigators often advise on and represent clients in commercial arbitrations as well as associated court proceedings. Miller, acted for a coalition of media interveners (the Media Coalition) in a high profile appeal heard in the Supreme Court of Canada on October 6, 2020: Sherman Estate v. Donovan. The case engaged important issues regarding access to court files, freedom of expression and freedom of the press.
