On Assignments ---- Builder's lawyers now say.... "It is also important to note that due to recent CRA policies with respect to Assignments, the Vendor will no... longer be allowing the assignment of the HST rebate credit from the Assignee to the Vendor on final closing. Accordingly, if the Assignee is eligible for a New Housing Rebate or new Housing Rental Rebate, the Assignee will need to make an application directly to CRA after final closing. This will also be detailed in the assignment documents to be prepared by our office." This means that, on FINAL CLOSING, MANY builders are CHARGING THE HST REBATE amount on top of normal builder closing costs for ALL assignments (whether you are living there or it is an investment). Therefore: Be ready to close with an extra 24K on all assignments. The good news is we can then get most or all of this money back for you 3-4 months after closing via various Rebates we can get for you. Have a great weekend and I love you.

How does the Covid19 situation affect New Construction Buyers? A pandemic is considered an "Unavoidable Delay" ("UD"). Therefore, the new home warranty (Tario...n) allows a Builder to unilaterally amend the schedule of critical dates by the period of the UD by giving notice to buyers. Let's assume the following is the existing schedule of critical dates: 1st Tentative Date: May 1, 2020 2nd Tentative Date: Sept 1, 2020 Firm Closing Date: Feb 1, 2021 Outside Closing Date: Sept 1, 2021 First Day a buyer could cancel the contract: Sept. 2, 2021 Last day a buyer could cancel the contract: Oct 2, 2021 Because of the Unavoidable Delay, a Builder is entitled to revise that schedule by the length of the delay. So, if the Covid19 Lockdown lasts 30 days (more or less), the revised schedule would look more or less like this: Revised UD 1st Tentative Date: June 1, 2020 Revised UD 2nd Tentative Date: Oct 1, 2020 Revised UD Firm Closing Date: March 1, 2021 Revised UD Outside Closing Date: Oct 1, 2021 Revised UD First Day a buyer could cancel: Oct 2, 2021 Revised UD Last day a buyer could cancel: Nov 2, 2021 Not all builders will invoke the provisions of the Warranty to reschedule your dates. However, if you have received a Notice of an Unavoidable Delay, the builder must also send you a Revised Schedule of Critical Dates once the length of the delay is know. Best Practices in an Assignment Whether you are a seasoned investor, a realtor or an end-user, ASSIGNMENTS can be complicated. Here are our top 5 tips when it comes to an Assignment Agreement: Make sure all details exactly match the Original builder Agreement (i.e. unit number/level number/ parking/ locker details/ names of parties). Be wary of Amendments which change things!... Make the Assignment Agreement conditional upon obtaining builder consent within 30 days from the acceptance of the Agreement - shorter timelines may not be enough. Define a specific assignment Closing date, and set out when the various payment(s) (such as deposits and profit) should be released. Ensure that payment for all extras/upgrades is included in the Assignment Agreement. Make your Agreement conditional upon lawyer review for at least 5 business days by an amazing lawyer who knows assignments well!
