Happy Monday! There is a lot of misconception regarding RPRs and Title Insurance when selling or purchasing a home. Here is some information regarding RPRs, Title Insurance and the importance of obtaining a real property report before you list your property for sale. If you are selling a house or a bare land condo in Alberta and are using the standard Alberta Real Estate Association contract, you are required to provide the buyer with a current real property report (RPR) and ...compliance. A RPR is a survey of the outside of the property which shows fences, decks, sheds, outbuildings, retaining walls, etc. this survey is then given to the City to ensure that all of the structures are in the right spot and if all development permits have been pulled. The survey must reflect the current state of the property. If there is something that is not shown on the RPR or if something has changed or has been moved, a new RPR is needed and it must be resubmitted to the municipality to get a new compliance report. If there is an issue with obtaining compliance, the municipality will issue a report letting the seller know what is wrong and what must be done to correct the problem. The seller must be able to fix any issue sand provide the new buyer with a new/current RPR and compliance before the possession date, otherwise the purchaser can potentially move in to the property without paying in full. Obtaining a real property report prior to listing you house for sale is very important so that you are aware of these issues before it is too late to fix them. Some sellers will offer a purchaser a policy of title insurance in lieu of a RPR and compliance. While this may seem sufficient, it is not an equal substitute. A title insurance policy may cover the cost of issues that were not know at the time of purchase and come up at a later date, but it is uncertain what may be covered. The best solution is to have a current RPR with compliance and a policy of Title Insurnace as well to potentially cover any unknown issues.
